Overview
DSI’s goal is to achieve high standards of product reliability and performance and our Limited Warranty Policy is unparalleled in the wireless monitoring industry – this reflects DSI’s confidence and over 25 years of experience as well as our increasing investments in product design and testing.
The in vivo environment presents significant product reliability challenges, especially for electronic devices used for chronic applications. Included in our warranty policy is a three-part program covering our implanted transmitters with separate warranty durations for (i) battery life, (ii) implant life, and (iii) maximum warranty period. DSI has a broad range of transmitters for application from mouse to large animal models, and warranty periods vary based on the transmitter model and its intended application. DSI also offers warranties on our non-implanted hardware products, typically of one year duration. This version of the warranty policy will be in effect as of December 1, 2009 and will supersede any previous warranty policies or references to the warranty in other printed materials.
DSI Transmitter “Exchange” Program
For customers wishing to explant and reuse transmitters, DSI pioneered the concept of transmitter refurbishment -- what we call our Exchange Program -- to optimize transmitter reliability as well as to lower production costs and pass those savings on to customers.
Our Exchange program has been very popular, and provides customers with our best transmitter quality, reliability and value. DSI seeks to protect the enormous customer time and expense invested in research studies, and when refurbished by DSI, transmitter catheters, leads, batteries, and housing are replaced and the electronics are thoroughly tested and recalibrated, and replaced if they do not meet DSI specifications. The result is a “good as new” transmitter with the same warranty coverage as a new transmitter – but at a much lower price.
The special Exchange Program pricing remains available until the transmitter model goes out of production. The only restriction is that transmitters must be carefully handled and returned in a condition amenable to refurbishment, and for this reason, transmitters with significantly damaged housings (i.e. beyond normal wear and tear) will not be available for the Exchange Program if any technical problems are found.
Transmitter Warranty Duration Details
DSI warrants to customers that, for each of the warranty periods set forth below, DSI implanted transmitters and other products shall conform to DSI’s applicable published specifications in effect at the time of shipment, and shall be free from defects in materials and workmanship.
For implanted transmitters, the “Warranted Battery Life Period” (WBLP) shall be the aggregate of the periods of battery “on time” for each product. For example, if the battery is turned on for use on January 1 and turned off on March 1 of the same year, the individual period of battery on time would be two (2) months. If all periods of battery on time exceed the Warranted Battery Life Period when added together, the device is no longer under warranty. The Warranted Battery Life Period is specified per transmitter model below.
The “Warranted Implant Period” (WIP) is the period of time over which DSI warrants the device to perform in-vivo in accordance with specifications. For example, if a device is implanted in a research subject on January 1 and later removed on March 1 of the same year, the individual period of in-vivo use would be two (2) months. If the cumulative total of all periods of in-vivo use exceed the Warranted Implant Period, the device is no longer under warranty. DSI does not warrant the performance to DSI’s applicable published specifications for devices that have been implanted longer than the Warranted Implant Period whether during or beyond the Maximum Warranty Period. Therefore, if customers implant DSI implantable telemetry devices for longer periods of time than the Warranted Implant Period, the customers assume all risk of device failure, compromised data quality or other adverse effects.
The “Maximum Warranty Period” (MWP) is the continuous period commencing on the date that each product is shipped to the customer and shall continue for the specified number of months as shown in the table below in the column under the heading MWP. If transmitters are returned to DSI beyond this date for any reason, the customer will be charged with the Exchange Program fee.
DSI’s applicable published specifications such as accuracy and other performance parameters are valid only within the shorter of (a) the Warranted Battery Life Period (b) the Warranted Implant Period and (c) the Maximum Warranty Period. Device operation and data collection outside of warranty is done at the sole discretion and risk of the customer.

Warranty Coverage Details
During the Limited Warranty Period as defined above, if any of DSI’s products fail to function in accordance with DSI’s then current applicable published specifications and is either returned to DSI, or DSI is notified in writing prior to the end of the Warranty Period, DSI will repair or replace the product, or those non-conforming parts only, at no charge.
For transmitters returned outside of warranty, DSI shall charge the standard transmitter exchange fee. Note, however, that if the transmitter housing has been damaged such that, in DSI’s sole judgment, transmitter refurbishment cannot be accomplished, the warranty will be void and the Exchange Program will also not be available. The customer will need to purchase a new transmitter at the new transmitter price then in effect.
As a condition to replacement, DSI may request reasonable evidence showing the periods of implant duration and battery on time such as in the form of a written log. DSI may, in its discretion not provide a replacement under warranty absent a showing of such reasonable evidence. If DSI determines in its sole discretion that the product is not covered under warranty, DSI’s standard transmitter Exchange Program fee will apply.
As DSI introduces new transmitter and other hardware models, DSI will add the new products to the DSI Limited Warranty Policy. In addition, as production of certain models is discontinued, DSI will have no obligation to continue to offer either the Exchange Program or new transmitters.
The customer's sole and exclusive remedy under the foregoing limited warranty is that DSI will repair or replace, at DSI's option, any product manufactured by DSI which is defective in material or workmanship during the warranty periods based on the terms set forth below. No warranty will be honored if any such defect is caused in transit from the customer or by customer's negligence, alteration, operation contrary to instructions, misuse, abuse, or if used with parts or accessories not supplied by DSI. Any defective product must be returned to DSI for repair or replacement, transportation prepaid, and must be accompanied by a Product Investigation Form that will be supplied by DSI.
DSI EXPRESSLY WARRANTS THAT ITS PRODUCTS SHALL MEET ITS THEN CURRENT PUBLISHED SPECIFICATIONS WITHIN THE APPLICABLE WARRANTY PERIODS. DSI HEREBY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DSI DOES NOT WARRANT THAT ITS PRODUCTS WILL MEET ANY CUSTOMER’S REQUIREMENTS, THAT THE PRODUCTS WILL PRODUCE THE RESULTS EXPECTED BY CUSTOMER, WILL OPERATE IN THE COMBINATIONS (INCLUDING WITH PRODUCTS NOT SUPPLIED BY DSI) WHICH MAY BE SELECTED FOR USE BY THE CUSTOMER, OR THAT THE USE AND OPERATION OF THE PRODUCTS WILL BE UNINTERRUPTED OR ERROR FREE.
DSI DOES NOT MAKE ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, AS TO THE ACCURACY OF ANY DATA OR INFORMATION GATHERED USING THE PRODUCTS AND SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRCT, CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES DUE TO ANY ACTION TAKEN OR NOT TAKEN BY CUSTOMER AS A RESULT OF ANY DATA OR INFORMATION GATHERED USING THE PRODUCTS.
THESE WARRANTY TERMS ARE AN INTEGRAL PART OF DSI'S STANDARD TERMS AND CONDITIONS OF SALE.
